In 2013 the HSE's Approved Code of Practice (ACOP) L8 removed an artificial 300 litre limit for hot and cold-water systems.  The removal of the limit meant that all hot and cold-water systems in domestic rented properties now need a Legionella Risk Assessment.

In myth buster case 357 the HSE confirmed that Legionella testing is not a requirement for domestic sites unless there is doubt or concern of the sites control and prevention measures.  And testing on its own does not meet the requirements of the HSE's ACOP L8.  Our Legionella Risk Assessment template has been design so that landlords and those in charge of smaller domestic sites can carry out there own Legionella Risk Assessment.

Do I Need a Risk Assessment?

A Legionella Risk Assessment is a HSE requirement and can demonstrate compliance with the Housing and Planning Act, the Renters Right Act, the Decent Homes Standard and be uploaded to the Private Rented Sector (PRS) database.

Who Can Carry Out An Assessment?

The HSE does not state any requirements to be able to carry out a Legionella Risk Assessment other then being "competent".  For smaller domestic hot and cold-water systems only a basic understanding of Legionella is required to assess the risk.

Our risk assessment template is suitable for domestic hot and cold-water systems supplied by the mains cold-water supply and allows for two cold-water storage tanks, two water heaters, two expansion vessels, eight outlets and two TMV valves.  You can give a copy of the assessment to your residents, tenants, guests or even include it in your welcome packs as it gives advise on the required temperatures needed to prevent and control Legionella bacteria.

Giving advice to residents, tenants and guests on the temperatures required to minimise the risk of Legionella is an appropriate control and prevention measure for domestic properties.
